Both void and illegal agreements are not legally enforceable and do not create valid contractual obligations. While all illegal agreements are void, not all void agreements are illegal. The key similarities are:

  1. Not Enforceable by Law – Both void and illegal agreements cannot be enforced in a court of law.
  2. No Legal Rights and Obligations – The parties involved cannot claim legal rights or enforce performance under these agreements.
  3. Effect on Collateral Agreements – In both cases, any agreement related to the void or illegal contract may also become unenforceable.
  4. Cannot be Ratified – Neither void nor illegal agreements can be made valid by mutual consent or performance.
  5. Violation of Legal Provisions – Both types of agreements may arise due to non-compliance with legal requirements.
  6. Example – An agreement without consideration is void, while an agreement to engage in smuggling is illegal.

Thus, both types of agreements lack legal recognition and are not binding.
